MMM&K attorney, Paul McTague, obtained a defense verdict in favor of his client in a Suffolk Superior Court jury trial. The defendant, a Boston-based urologist, was monitoring the results from a patient’s prostate cancer-screening test, and the Plaintiff alleged that the defendant was negligent for failing to provide a diagnosis in a timely manner. The plaintiff further claimed that, as a result of the defendant’s actions, the cancer was able to permeate the plaintiff’s body beyond a point of cure, leading to a premature death.
Paul McTague, a partner at MMM&K, appeared on behalf of the defendant and after a five day trial, and 2.5 hour jury deliberation, a verdict was returned in favor of the defendant – nulling all claims of negligence.
